Terms and Conditions
These terms explain the agreement between you and Grit Gyms Ltd when you access BPH Protocol, use our website, download or use our app, join a programme, receive coaching, communicate with us, or use any related content, tools or community features.
Agreement
By using BPH Protocol, creating an account, buying a plan, downloading the app, booking a check-in, or continuing to use the service after these terms are made available, you agree to be bound by these terms. If you do not agree, you must not use BPH Protocol.
References to “BPH”, “BPH Protocol”, “we”, “us” and “our” mean Grit Gyms Ltd. References to “you” and “your” mean the person using the service or buying access to it. If you use the service on behalf of another organisation, you confirm you have authority to accept these terms for that organisation.
These terms should be read together with our Privacy Policy and Cookie Policy. If you buy through the Apple App Store or Google Play, the relevant app store terms may also apply to your purchase, billing, refunds and device-level app use.
Who we are
BPH Protocol is operated by Grit Gyms Ltd. We provide digital programmes, educational content, app-based tools, accountability support and coaching-style check-ins designed to help people move from drift to direction through structured weekly systems.
You can contact us about these terms, the service, or your account at hello@bphprotocol.com.
Our service
BPH Protocol is a 60-day personal direction system covering fitness, nutrition, recovery, appreciation, family presence, and personal or professional growth. The service may include digital tools, prompts, app content, check-ins, messaging, video calls, worksheets, educational materials, community features and support from our team.
The service is designed to provide structure, accountability and guidance. It is not a substitute for medical care, mental health care, financial advice, legal advice, employment advice or any other regulated professional service.
We may change, improve, suspend or remove features as the service develops. We will try to avoid changes that materially reduce the core value of a paid plan during a period you have already paid for, but we may need to make changes for security, legal, operational or technical reasons.
Eligibility
You must be at least 18 years old to buy or use BPH Protocol unless we expressly agree otherwise in writing and appropriate parental or guardian consent is in place. You must be legally able to enter into a contract and must use the service only for lawful purposes.
You are responsible for making sure that BPH Protocol is suitable for your personal circumstances, including your health, schedule, commitments, training history and available support.
Your account
You are responsible for the accuracy of information you provide, keeping your login details secure, and using the service for your own lawful personal development purposes. You must not share your account with another person unless we have expressly allowed it.
You agree to keep your account information up to date, including your email address, billing status and any information that affects the support or programme guidance we provide. If you suspect unauthorised access to your account, you should tell us as soon as possible.
Subscriptions
Paid plans, prices, included features, billing periods, trials, renewals and cancellation options will be shown before purchase. Unless stated otherwise, prices are shown before any taxes, app store fees, currency conversion charges or payment provider fees that may apply.
If you buy through Apple App Store or Google Play, your purchase, renewal, cancellation and refund rights may be handled by the relevant app store. You should manage app store subscriptions through your app store account settings.
If you buy directly from us, you authorise us or our payment provider to charge the payment method you provide. You can cancel future renewal where cancellation is available, but cancellation does not automatically create a refund for a period already started unless the law requires it or we agree otherwise.
We may change prices or plan features for future billing periods. If a change materially affects an active paid plan, we will provide reasonable notice where practical.
Coaching and communications
Some BPH plans may include in-app messaging, team check-ins, video calls or other forms of support. These services are intended to help you understand and apply the protocol, review progress, and make practical adjustments within the scope of BPH.
Coaching and support availability may depend on your plan, time zone, team capacity, public holidays, technical availability and reasonable scheduling requirements. Missed, late or cancelled calls may be subject to the booking or cancellation process in place at the time.
We may send service messages about your account, plan, support, security, billing, programme updates and operational changes. Marketing messages will be handled in line with applicable law and our Privacy Policy.
Health and safety
BPH Protocol is not medical advice. You should use your judgement, train within your ability, and speak to an appropriate health professional before starting if you have a medical condition, injury, concern, or are unsure whether a programme is suitable.
You are responsible for stopping any activity that causes pain, dizziness, shortness of breath, unusual discomfort, distress or any other warning sign. You should seek urgent medical help if you think you may be experiencing a medical emergency.
Nutrition, recovery, training and wellbeing content is provided for general educational and personal development purposes. We do not guarantee any specific physical, emotional, professional, financial or personal outcome.
Acceptable use
You must not misuse the service, interfere with its operation, share unlawful content, harass others, copy restricted content, or attempt to access accounts, systems or data that you are not authorised to use.
You must not upload or send content that is unlawful, abusive, discriminatory, obscene, defamatory, threatening, misleading, infringing, malicious, or likely to damage the service or another person. You must not reverse engineer, scrape, overload, probe, bypass, tamper with, or attempt to compromise the security of BPH Protocol.
We may suspend or restrict access if we reasonably believe that your use creates risk, breaches these terms, infringes rights, disrupts the service, harms another user, or exposes us or others to legal or operational risk.
Intellectual property
The BPH Protocol name, brand, content, app design, methods, materials and related assets belong to Grit Gyms Ltd or its licensors. You may use them only as permitted by the service and these terms.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use BPH Protocol for your own personal development while your account or plan is active. You must not copy, resell, publish, distribute, adapt, train models on, or commercially exploit our content without our written permission.
You keep ownership of content you provide to us, such as messages, check-in responses, preferences, progress notes and feedback. You grant us the rights needed to host, process, review and use that content to provide, secure, support and improve BPH Protocol.
Third-party services
BPH Protocol may rely on third-party platforms and providers, including app stores, payment processors, hosting providers, analytics tools, email services, calendar or video call providers, and customer support systems. These third parties may have their own terms and privacy notices.
We are not responsible for third-party services that we do not control. If you access a third-party link, platform, integration or app store, you do so subject to that third party’s rules and policies.
Availability
We aim to keep BPH Protocol available and reliable, but we do not guarantee that the website, app, content, messaging, video calls or other features will always be available, uninterrupted, error-free or compatible with every device or operating system.
We may suspend access for maintenance, updates, security, legal compliance, misuse, provider outages or operational reasons. Where practical, we will try to minimise disruption.
Ending access
You may stop using the service at any time. If you have a paid subscription, you must cancel it through the relevant app store, payment provider or account process to stop future renewal.
We may suspend, restrict or close your account if you breach these terms, misuse the service, fail to pay amounts due, create risk for us or others, or if we need to do so for legal, security or operational reasons.
Liability
We aim to provide a reliable service, but we do not guarantee uninterrupted availability or specific results. Nothing in these terms limits liability where it would be unlawful to do so.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, loss of profit, loss of opportunity, loss of goodwill, loss of data, or losses arising from your failure to use the service responsibly or seek appropriate professional advice.
If we are liable to you and the law allows us to limit that liability, our total liability will be limited to the amount you paid to us for BPH Protocol in the 12 months before the event giving rise to the claim.
Changes
We may update these terms as the service develops. The latest version will be published on this page with the updated date.
If a change is material, we will take reasonable steps to bring it to your attention, such as through the website, app or email. Continuing to use BPH Protocol after updated terms take effect means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales, unless mandatory local consumer laws give you additional rights that cannot be excluded. The courts of England and Wales will have jurisdiction, subject to any mandatory rights you have to bring a claim elsewhere.
